1. Terms, condition and Agreement:

In these Terms and Conditions "we" and "us" or “our” mean www.cosmeticonline.com.au and "you",” user”, “visitor” means you the customer. These Terms and Conditions are the entire sale and purchase between us and you for the supply of Products/ Goods/ Service. These terms and conditions and agreement cannot be varied unless we agree to vary it in writing or by email.
You must read these terms and conditions carefully and understand them before accessing/or visiting and/or using the Site/link. By placing an order to purchase any product/goods/service on the Site, you acknowledge and agree that you have read and understood these terms and conditions. If you are an under 18 years of age, you must obtain your parent or guardian's consent before accessing and purchasing from the Site.
If you do not agree to any terms and condition of this agreement, you must not use the website.
By registering with us and by purchasing products from the Site you agree to be bound, and to comply with, these terms and conditions.

2.Registration and Order placement:

It is compulsory for you to register on our site before placing the any order. You cannot transfer your account. You may make update, edit or terminate your account at any time.
You acknowledge and agree either by visiting or using these site that you are solely responsible for ensuring that you comply with the rules, policies or protocols that apply to the use of your email address.
You may order products and service by selecting and submitting your order through the Site in accordance with these terms and conditions.

3. Order cancellation and rejection:

You may cancel your order by any reason. In these cases, you may be charged up to 25% of your total amount if once order is processed.
We reserve the right to accept or reject your order for any reason including, but not limited to, the unavailability of any product, an error in the price or product description, or an error in your order. In that case we can cancel your order and we will provide you a full refund of any payment received.

4. Price, Payments and shipping:

All prices are displayed in Australian Dollars (AUD). We reserve the right to change prices for products or services displayed at our site any time before you place an Order.
The price of products shown on the site include all taxes except shipping costs. Shipping cost may be variable based on how many and what items you place in your shopping cart.
We do not allow personal pick up.
All payments must be received in full prior to dispatch. Your order will be processed once your payment is cleared. If your payment is not received or declined by your bank or credit card issuer, we cannot hold product against your order.

5. Supply and Delivery of products:

Subject to these Terms and Conditions, we will supply to you the Products indicated on your Order Confirmation. When your Order items have been dispatched, we will email you to confirm shipment of each item.
Delivery time normally takes 3 to 21 working days from the date your payment is received. You understand that we will use our best endeavours to meet stated timeframes for dispatch and delivery, however many factors can affect these timeframes and we cannot guarantee that they will always be met.
The estimated delivery times are in business days (Monday through Friday) excluding Public holidays.
Title and risk of loss to all Products will pass to you on delivery.

6. Returns of product or defective/faulty product:

Our customer is a number one priority for us. You can return the product in following condition:
* Item you received is defective.
* Item is damaged in the post.
* If any incorrect item was delivered.
* Any product/item is different from its advertisement or description.
* Any item accidently left out of your delivery or could not be fulfilled.
Please choose carefully. We do not normally give refunds if you simply change your mind or make a wrong decision. However, if you wish to return products in their original packaging and in saleable condition, we will provide you with a store credit for the purchase price less delivery fee.
Please contact us via the help centre to obtain a Return Authorisation Number as no returns can be accepted without one.

7. Limitation of liability:

You accept all risks and responsibility for all loss, damage, costs and other consequences resulting from using the Site/link or the content or material on or accessible through the Site.
We will not be liable for any loss whatsoever (including, without limitation, indirect, incidental, special, or consequential loss, loss of profits or loss of opportunity), expense, damage, or injury that is suffered (however so caused) in connection with your access to, or use of, or inability to use the Site or the content or material of the Site (including linked websites), whether based in contract, tort, negligence, statute or any other legal theory, except for any liability that cannot be excluded by law.

8. Warranties:

We provide the Site on an "as is" basis without any express or implied warranty of any kind. While we exercise all due care and precautions, we cannot and does not guarantee or warrant that files available for downloading through the Site or delivered via electronic mail will be free of infection, viruses, defects, harmful components or any other codes that may have contaminating or destructive properties. * the resupply of the goods; or
* the reasonable cost of having the goods resupplied.

9. Force Majeure:

To the extent permitted by law, we is not liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of ours and we shall be entitled to a reasonable extension of time for the performance of such obligations.

10. Governing Law:

These Terms and Conditions shall be governed by and construed in accordance with the laws of ACT and shall be subject to the non-exclusive jurisdiction of the courts of ACT.
